Village Cycles Terms and Conditions

You are paying for a Rental of a bike and associated equipment (collectively the “Rental Bike”) of Mai Adventures LLC d/b/a Village Cycles (“Village Cycles”), and this Bike Rental Agreement and Release (“Agreement”), sets out the terms and conditions associated with such use.

Your use of the Rental Bike is specifically subject to the following terms and conditions, and your removal of the Rental Bike from Village Cycles shall be deemed acceptance of these terms and conditions.

Any Rental Bike returned late will be subject to a fee twice the rental rate.

Any part broken during your possession and/or use of the Rental Bike will be chargeable to you at full retail value at Village Cycles’ sole discretion.

Tire punctures will be repaired by Village Cycles at your expense.

Any damage from whatever cause shall be paid for by you.

Theft is a growing issue and it is the customer’s responsibility to make sure the Rental Bike is secured appropriately when not in use or unattended. You shall be obligated to pay the full retail price for the Rental Bike if it is stolen or otherwise not returned to Village Cycles within five (5) days of the end of the rental period.

You shall use reasonable and recognized means to secure the Rental Bike during transport, using only bike racks and equipment that is suitable and in good condition to accomplish such transport.

You shall wear a proper helmet and other protective equipment during all use of the Rental Bike.

You shall not remove, change, add or modify any components or parts on the Rental Bike.

You shall ride on trails and areas that are suitable for your skill and experience and take all precautions and time to learn the characteristics of all trails that you will be riding with the Rental Bike.

You will not allow any person to ride or operate the Rental Bike unless they have signed a Village Cycles Bike Rental Agreement and Release.

You shall not use alcohol or be under the influence of any drugs while using the Rental Bike.

E-BIKE RENTALS

You must be at least sixteen (16) years of age to use an e-bike. Additionally, the use of e-bikes is subject to further rules and restrictions. This may include, but is not limited to, outright prohibitions on the use of e-bikes in certain areas. You shall make yourself aware of the rules and regulations relating to the use of e-bikes and shall always comply with such rules and regulations. This includes, but is not limited to, refraining from using any e-bike in areas where such use is prohibited.

PAYMENT AUTHORIZATION

Upon submission of my reservation agreement for the Rental Bike, I authorize Village Cycles to charge a deposit of $500 U.S. to my credit card. I further authorize Village Cycles to place an authorization hold on the credit card account which will be released once the bike is returned and inspected for any damage. Village Cycles is hereby authorized to use my credit card account to collect for any damage to or loss of the Rental Bike, without further consent or authorization from me. I understand that a credit card hold can take up to two weeks to clear the relevant account.

If I cancel my reservation fewer than twenty-four (24) hours from the start of my original rental period, for any reason, including but not limited to weather, ferry delay, ferry cancellation, and/or ferry schedule changes, I authorize Village Cycles to charge my credit card with the full payment. I understand that Village Cycles is not responsible for notifying me of changes to ferry schedules, ferry cancellations, or ferry delays. We do not offer refunds or reservation transfers for wrongly selected dates.

If I do not return my Rental Bike at the end of my reserved rental period, then I authorize Village Cycles to charge my credit card with a late fee equal to twice the total rental amount per each day that I fail to return the Rental Bike.

ACCEPTANCE OF RISK

I understand and accept that riding a bike exposes me to many hazards and may cause death, personal injury, and loss of or damage to property. By signing this document, I accept such risks and hereby assume to the greatest extent allowed by law all risk of injury or loss of life to myself and to others, and loss of or damage to property that may occur while riding this Rental Bike. I understand the risk involved in using this Rental Bike and I accept full responsibility for all damage or injury which may result.

COMPLETE WAIVER AND RELEASE IN CONSIDERATION FOR BEING ALLOWED TO TAKE AND USE THE RENTAL

BIKE, I HEREBY RELEASE, WAIVE AND FOREVER DISCHARGE VILLAGE CYCLES, ITS AFFILIATES, MEMBERS, MANAGERS, OFFICERS, DIRECTORS, SHAREHOLDERS, AGENTS, EMPLOYEES, AND LIABILITY CARRIERS FROM ANY AND ALL LIABILITY OR CLAIMS FOR INJURY, ILLNESS, DEATH OR LOSS OF OR DAMAGE TO PROPERTY WHICH I MAY SUFFER OR CAUSE ARISING FROM MY POSSESSION OR USE THE RENTAL BIKE AND ASSOCIATED EQUIPMENT, AND PARTICIPATING IN CYCLING. THIS DISCHARGE SPECIFICALLY INCLUDES, BUT IS NOT LIMITED TO, LIABILITY OR CLAIMS FOR INJURY ILLNESS, DEATH OR DAMAGED CAUSED BY THE NEGLIGENCE OR OTHER FAULT OF VILLAGE

CYCLES OR ITS AFFILIATES, OFFICERS, MEMBERS, MANAGERS, DIRECTORS, SHAREHOLDERS AGENTS, OR EMPLOYEES. I SHALL HOLD HARMLESS, INDEMNIFY AND DEFEND VILLAGE CYCLES FROM ALL LIABILITY, INJURY

ILLNESS, DEATH ARISING OUT OF MY USE AND POSSESSION OF THE RENTAL BIKE AND ASSOCIATED EQUIPMENT, INCLUDING, BUT NOT LIMITED TO, PROPERTY LOSS OR DAMAGE, PERSONAL INJURY OR LOSS OF LIFE, ALL TO THE GREATEST EXTENT ALLOWED BY LAW WHETHER CAUSED BY THE NEGLIGENCE OF VILLAGE CYCLES OR WHETHER BASED UPON BREACH OF CONTRACT, BREACH OF WARRANTY, OR ANY OTHER LEGAL THEORY. SUCH DUTY SHALL INCLUDE THE OBLIGATION TO PAY FOR ALL OF VILLAGE CYCLES’ ATTORNEYS’ FEES AND COSTS IN DEFENDING ANY SUCH CLAIM, DEMAND, INJURY, SUIT OR ACTION. I SHALL HAVE NO RIGHT TO MAKE A CLAIM OR FILE A LAWSUIT AGAINST VILLAGE CYCLES OR ITS AFFILIATES, MEMBERS, MANAGERS, OFFICERS, DIRECTORS, SHAREHOLDERS, AGENTS OR EMPLOYEES, EVEN IF THEY NEGLIGENTLY CAUSED MY INJURY, ILLNESS, DEATH, OR DAMAGE.

I have carefully read this agreement in its entirety and understand its content. I am aware this is an acceptance of risk, waiver and release and I sign it voluntarily. I also understand that I should not and may not participate in this activity if I am under the influence of alcohol and/or drugs.

TO BE COMPLETED BY THE PARENT OR GUARDIAN OF ANYONE UNDER THE AGE OF 18

I DO HEREBY AGREE TO HOLD HARMLESS, INDEMNIFY AND DEFEND MAI ADVENTURES LLC D/B/A VILLAGE CYCLES ITS AFFILIATES, OFFICERS, DIRECTORS, SHAREHOLDERS AGENTS, OR EMPLOYEES TO THE GREATEST EXTENT ALLOWED BY LAW FROM AND AGAINST ANY CLAIM, DEMAND, INJURY, SUIT OR ACTION THAT MAY BE COMMENCED BY ANYONE ARISING OUT OF THE USE OR POSSESSION OF THE RENTAL BIKE BY THE PRINCIPAL SIGNATOR/USER, INCLUDING THOSE RAISED BY SUCH PRINCIPAL SIGNATOR/USER. SUCH DUTY SHALL INCLUDE THE OBLIGATION TO PAY FOR ALL OF MAI ADVENTURES LLC D/B/A VILLAGE CYCLES’ ATTORNEYS’ FEES AND COSTS IN DEFENDING ANY SUCH CLAIM, DEMAND, INJURY, SUIT OR ACTION.
